New York no longer discriminates against parties based on sexual orientation. Provided that the parties in a same-sex union were married in a state that recognized the marriage as lawful when entered into, and the parties can otherwise satisfy the residency requirements for a New York divorce action, they are free to commence an action for divorce in New York.
